Terms & Conditions

 

Introduction The Provider is an agricultural entrepreneur and carries out hospitality, tasting and tour activities in accordance with Tuscan Regional Law no. 30 of 23 June 2003 as subsequently amended. These Terms and Conditions govern the provision of agritourism and wine tourism services, which are connected and complementary to the company’s main agricultural activity. These General Terms and Conditions (hereinafter “T&C”) govern the purchase of the services offered by Tenuta di Valgiano sas, which consist of: a) Organisation of tastings and guided tours at the estate. b) Rental for tourist purposes of a property unit known as “Villa la contessa”.  

Submitting a booking request implies full and unconditional acceptance of these T&C.

  1. Identity of the Provider Pursuant to Art. 48 of Legislative Decree no. 206 of 6 September 2005 (Consumer Code), the identification details of the service provider (hereinafter the “Provider”) are provided below:

SECTION A: TASTINGS AND TOURS

  1. Conclusion of the Contract The contract is deemed concluded when the Customer receives written confirmation of the booking from the Provider, following the correct completion of the request procedure and payment. The mandatory pre-contractual information is provided during the booking process and summarised in the order confirmation.
  2. Fees and General Payment Methods The prices of the tasting services are indicated on the website or communicated at the Customer’s request. Unless otherwise indicated, prices include VAT. The specific payment methods for each service are detailed in this section.
  3. Subject and Nature of the Service The Provider organises tastings and product samplings in accordance with Tuscan Regional Law no. 30/2003 as subsequently amended and the related implementing regulation. Tasting Formulas: Various formulas are available, such as the “Convivial Tasting”, which includes the tasting of 3 wines produced at Tenuta Valgiano, the “Full Tour”, which includes the tasting of 4 wines produced at the Tenuta, as well as honey and oil produced at the Tenuta, service for a minimum of 3 people, the “Full Tour with Lunch ”, which includes the tasting of 4 wines produced at the Tenuta as well as a 4-course lunch highlighting the seasonality of the available products, and the “Full Tour with Retrospective of Old Vintages”, a tasting of 5 historic vintages of the Tenuta di Valgiano winery, to be defined. The specifications and costs of each formula are detailed on the website.
  • Products Used: Tastings are carried out with the company’s own products, supplemented, in the formula including lunch, by products from local farms and products of Tuscan origin, enhancing local and seasonal production, in accordance with Art. 2 of Tuscan Regional Law no. 30/2003.  
  1. Bookings and Payments for Tastings
  • Booking and Deposit: Booking is mandatory. To confirm it, immediate payment of an advance deposit of 50% of the total price is required, with the remaining 50% balance to be paid no later than 15 days before the date of the event. For bookings made less than 15 days before the event, immediate payment of 100% of the amount is instead required at the time of booking. Booking requests can be made via the website, by e-mail or by telephone. The booking is deemed completed and confirmed only after the Customer has received a written communication from the Facility and payment has been made via the online platform Stripe within the terms indicated in the pre-acceptance communication.

For bookings made less than 3 days before the event payment is made directly at the facility in cash, by debit card or by Visa / Mastercard credit card; in such cases, the card number and CVV2  of a valid credit card will be requested as a guarantee, on which the Facility may arrange a pre-authorisation of the amount.

  • Notification of Allergies and Intolerances: The Customer is required to notify in writing, immediately at the time of booking, any FOOD ALLERGIES OR INTOLERANCES. In the absence of such notification, the Provider declines all liability.
  1. Cancellation Policy for Tastings Cancellation is subject to the following conditions:
  • Free cancellation: cancellation made up to 7 days before the booked date.
  • 50% penalty: For cancellations made from 7 to 3 days before the date, 50% of the total price paid will be retained.
  • 100% penalty: For cancellations made from 2 days before the date or in the event of failure to show up (no show) 100% of the price paid will be retained.

SECTION B: WEEKLY RENTAL “VILLA LA CONTESSA”

  1. Subject: The stay offered at the accommodation facility takes place within the Provider’s farm and constitutes an activity connected to it. The stay offers the Customer the opportunity to get to know the rural territory and the agricultural activities of Tenuta di Valgiano sas. The service consists of granting the use, for periods of not less than 7 days, of a property unit described in more detail on the website with photos for tourist purposes. The ground floor of the house opens with an entrance hall leading to a dining room, followed by a kitchen and a guest bathroom. The first floor consists of an open living room with a sitting area overlooking the vineyards and two large suites with walk-in wardrobe and private bathroom. The second floor has a second sitting room and two double bedrooms with bathroom. Each room has air conditioning. The residence is furnished with works of art and antiques. Underfloor heating, LPG gas for cooking; electric car chargers outside in the car park; air conditioning; Wi-Fi system. Each bathroom is equipped with a hairdryer, shower gel and shampoo kit, and towels. There is a sauna and swimming pool provided with towels. Guests also have the use of a laundry room equipped with a sink, washing machine, ironing board and iron. Daily cleaning is included in the price. The rental can be booked through the Airbnb website (host name “Villa la contessa”), to which reference is made; booking entails automatic acceptance of the platform’s Terms of Service and policies, which govern the relationship between host and guest, including cancellation and refund policies. As regards prices, those displayed on the Airbnb website for the rental periods shall prevail. Per-night, per-person tourist tax charges, currently still awaiting approval by the Municipality of Capannori, will instead be settled in cash at the facility.
  2. Check-in and Check-out
  • Check-in: From 3:00 p.m. to 5:00 p.m. Arrivals outside these hours must be agreed in advance. At check-in, a valid identity document must be presented for each guest for the registrations required by law  
  • Check-out: By 10:00 a.m. on the day of departure.
  1. Responsibilities of Guests and of the Facility
  • Guests’ Responsibilities:
    1. The Guest, as tenant, takes custody of the property and undertakes to use it with the diligence of a responsible person (“buon padre di famiglia”), keeping it in good condition and returning it in the same condition in which it was delivered.
    2. The Guest is liable for any damage caused to the property, furnishings, household appliances and any other assets owned by the Facility, caused by the Guest or by third parties admitted by the Guest to the property. Any damage must be immediately reported to the Management and compensated.
    3. The Facility is not liable for the theft, loss or damage of goods or valuables belonging to the Guest left inside the property, as this is a tourist rental and not a hotel contract.  
  • Limitations of the Facility’s Liability:
    1. The Facility cannot be held liable for damage resulting from improper use of the property and its equipment by the Guest.
    2. The Facility declines all liability for temporary service disruptions not attributable to its fault, such as interruptions in the supply of electricity, water, gas or internet connection depending on third-party suppliers or on force majeure.

FINAL PROVISIONS

  1. Processing of Personal Data The personal data provided by the Customer will be processed by the Provider in compliance with the legislation on the protection of personal data (EU Regulation 2016/679 and Legislative Decree 196/2003 as amended).   2. Exclusion of the right of withdrawal: The Customer is informed that, since these contracts concern the provision of accommodation for non-residential purposes and leisure services with a specific date of performance, the right of withdrawal provided for by Articles 52 et seq. of Legislative Decree no. 206 of 6 September 2005 (Consumer Code) does not apply, pursuant to the exception set out in Art. 59, paragraph 1, letter n) of the same code. The Customer therefore cannot exercise the right of withdrawal within 14 days of the conclusion of the contract. The conditions for any cancellation of the booking by the Customer are governed exclusively by the cancellation policies specified in Section A of these Terms and Conditions as regards tastings and, as regards the rental of the property, by reference to those on the Airbnb portal.
  3. Applicable Law and Competent Court These T&C are governed by Italian law. For any dispute, where the Customer is a “consumer”, the mandatory territorial jurisdiction lies with the court of the consumer’s place of residence or domicile, if located within the territory of the Italian State. In all other cases, the Court of Lucca shall have exclusive jurisdiction.
